Fort Collins, Larimer County, DUI Lawyer

Fort Collins, Colorado is located in Larimer County, Colorado.  It is formerly a military post of the U.S. Army.  Present day Fort Collins has a population of 148,612; and Larimer County has a population of 310,487.

Money Magazine
voted Fort Collins, Colorado the 2nd best place to live in the United States in 2008.  In 2013, Forbes Magazine named Fort Collins, Colorado as the 7th "Best Places for Business and Careers".  Undoubtedly, Fort Collins has a lot going for it.

Although Allstate Insurance named Fort Collins as "America's Safest Driving City" two years in a row in 2011 and 2010, Fort Collins also has more than its fair share of DUI arrests.  In 2012, the Larimer County District Attorney's Office prosecuted 1077 drivers for DUI/DWAI.  Of that number, 1061 cases were charged as a DUI, meaning the police officer and the district attorney believed that the driver was substantially incapable of safely operating a motor vehicle.  Only 16 cases were charged as DWAI, meaning that the police officer and the district attorney believed that the driver's ability to drive was impaired even to the slightest degree.

The average BAC for all cases prosecuted in Larimer County in 2012 was .153, which is approximately three (3) times the "legal limit" for the presumptive range of DWAI and almost two (2) times the presumptive range for DUI in Colorado.

According to Colorado Statute, a driver is inferred to be impaired by alcohol if his BAC is at least .051, but less than .08.  Conversely, if a driver's BAC is .05 or less, there is a presumption that the driver is not under the influence of alcohol and not impaired by alcohol.  And if the driver's BAC is .08 or greater, there is a permissible inference that the driver was under the influence of alcohol.  Unfortunately, there is a common misconception that the "legal limit" is .08, but in reality it is .051.

Larimer County prosecutes DUI offenses from two (2) separate courthouses, depending upon the geographic area of where the alleged offense occurred.  The main courthouse is located in Fort Collins at 201 LaPorte Avenue in the Larimer County Justice Center.  Other cases are handled in Loveland at the Loveland County Court, 810 East 10th Street, Loveland.

Express Consent Revocation Hearings in Fort Collins are held via telephone and coordinated through the Lakewood, Colorado Hearings Division at 1881 Pierce Street.  Fort Collins no longer maintains a hearings office for in-person hearings.  There are only five remaining hearing offices in Colorado: Lakewood, Colorado Springs, Boulder, Greeley, and Grand Junction.

Some of the common police agencies for DUI arrests in Larimer County include: Larimer County Sheriff's Department, Fort Collins Police Department, Loveland Police Department, Estes Park Police Department, Berthoud Police Department, Johnstown Police Department, Wellington Police Department, Timnath Police Department, Colorado State University Police Department, and Windsor Police Department.

★★★★★
"An excellent lawyer choice for my son who was charged with driving while his license was revoked. DMV had mistakenly sent (3) letters of revocation to the incorrect address, so I hired Monty to prove that my son never knew his license was revoked. Monty kept me informed at all times as to what was happening and what he doing to prove my son's innocence in this matter. We were to appear in court on 29 March 2012 and Monte informed us on 27 March 2012, that the case had been dismissed!!! Monte charged a fair, flat rate for what he did in this matter and should the need arise to hire a lawyer or to recommend a lawyer, I would not hesitate to give Monte's name.” Linda

"I consulted three other attorneys on my traffic offense in Colorado and none of them thought I could beat it. Then I consulted with Monte Robbins. He not only relieved my warrant without my presence in Colorado, but he got my habitual driving offense reduced to an infraction. I was up against the wall on this case but thanks to Monte miracles are possible. I have hired my share of attorneys and Monte Robbins has produced the best results for me yet. After being without my driving privileges for ten years I paid a small fine and am legal with a clean record. I Highly recommend this attorney." Steve
