Denver Colorado Warrants Lawyer

When a Defendant does not appear in court as scheduled, the court will typically issue a bench warrant for the Defendant’s failure to appear.

If the bench warrant stems from a traffic violation, the warrant (OJW) will cause a hold on the person’s driver’s license at the Colorado Division of Motor Vehicles (DMV). Consequently, the person’s driver’s license will be suspended if the warrant is not immediately satisfied.

Often times these warrants can be “quashed” or “vacated” with the assistance of vigilant counsel who files a motion to quash the warrant. Depending upon the facts and circumstances of the particular case and the jurisdiction, the court may or may not grant the request to quash the warrant.

Out-of-state drivers often encounter problems with warrants from unresolved traffic tickets in Colorado when they go to renew their driver’s licenses in their home state. Their home state will typically notify them that they have a “hold” on their license from Colorado as reported on the “national list”. If they are on the national list, their home state will typically not renew their driver’s license.

If the warrant is quashed, a driver may or may not be required to appear in court. Some cases may be resolved upon the appearance of an attorney with or without a telephone appearance by the defendant. Once the warrant is quashed, the OJW fee may be paid and a driver can immediately reinstate his/her driver’ license after fulfilling the reinstatement process at DMV.

Some non-traffic warrants may also be quashed depending upon the jurisdiction, charge, and facts of the particular case. Examples of these warrants include a warrant for failure to comply with probation, a warrant for failure to pay court fines and costs, and a warrant for failure to comply with conditions of bond or violating conditions of bond. If an attorney is successful in vacating or quashing the warrant in a non-traffic case, the defendant will not have to be arrested and taken into custody and thereafter post a bond. Depending upon the facts and circumstances of the particular case, a defendant’s appearance may also be waived with the assistance of a lawyer in some non-traffic cases.
