Habitual Traffic Offender

In order to qualify as a Habitual Traffic Offender, a driver in Colorado must have three (3) or more convictions of certain offenses within a seven (7) year period. There are numerous habitual offenses in Colorado. The following offenses qualify as “Habitual Offenses”: vehicular homicide, vehicular assault, DUI, driving under revocation, driving under suspension, driving under restraint, DWAI, DUI per se, false affirmation or false swearing regarding administration of motor vehicle laws, aggravated motor vehicle theft, hit and run resulting in death, hit and run resulting in injury, reckless driving, and manslaughter or criminally negligent homicide related to the operation of a motor vehicle.

Aside from false affirmation or false swearing regarding the administration of motor vehicle laws, Colorado will consider a driver’s prior convictions from another state, under any federal law, and under any municipality.

A driver may also qualify as a Habitual Traffic Offender is she is convicted of a minimum of ten (10) four (4) point (or more) tickets in a period of five (5) years. This provision includes the habitual offenses listed above. Or, a person may be deemed to be a Habitual Traffic Offender if he is convicted of a minimum of eighteen (18) infractions with three (3) or fewer points each in a five (5) year period. This provision also includes the offenses listed above.

The Colorado DMV will immediately revoke the driver’s license of a Habitual Offender for a period of five (5) years.
