⚖️ Why Hire Me for an El Paso County DUI

I’m Monte Robbins — DUI & serious traffic defense attorney with

20+ years focused on DUI and high-stakes driving cases across Colorado.

When you hire me:

  • You work directly with me — not a case manager
  • I handle both sides of your case: ➤ DMV Express Consent hearing (license) ➤ Criminal case (court)
  • I challenge stop legality, roadside tests, blood / breath procedures, chain of custody
  • You’ll never show up to court and find a stranger standing next to you

DUI cases in El Paso County move quickly — early legal action protects your options.

⚑ Military DUI (Fort Carson / USAFA / Peterson SFB)

A DUI can impact more than your driving privileges —

it can affect your career, command standing, and security clearance.

Military consequences vary by branch and command.

They can include, but are not limited to:

  • Loss of on-base driving privileges
  • Command discipline / UCMJ action
  • Security clearance review or suspension
  • Impact on promotion, assignment, or retention eligibility

I handle the civilian criminal case + DMV, and encourage service members to consult JAG or their command for administrative / military matters.

❓ Frequently Asked Questions

Q: Will I lose my driver’s license after a DUI arrest?

A: You have 7 days from the date of arrest to request an Express Consent DMV hearing. If you miss the deadline, your license is revoked automatically.

Q: Do I have to appear in person in El Paso County Court?

A: Not always. For many misdemeanor DUI cases, I can appear on your behalf for procedural settings. Judges may require personal appearance for advisement, plea, or sentencing.

Q: What happens at the DMV Express Consent hearing?

A: I challenge the legality of the stop, whether probable cause existed, and blood/breath procedures. This hearing only determines whether the DMV revokes your license.

Q: Can a DUI be reduced or dismissed in El Paso County?

A: Sometimes. If evidence is weak, testing or procedure was flawed, or constitutional issues exist, I push for reductions or dismissal. If needed, we take the case to trial.

Q: I’m from out of state — do I have to fly back?

A: Often no. I structure the case to minimize travel, but judges control appearance requirements.

Colorado allows early reinstatement with ignition interlock for most chemical-test DUI revocations.

Refusals require a 60-day no-drive period before eligibility.

Requirements include:

  • Colorado residency
  • SR-22 insurance filing
  • Ignition interlock lease
  • Reinstatement paperwork + fees

Out-of-state residents:

Colorado law does not allow early reinstatement until residency is established, and your home state may impose its own sanctions.

I guide clients through SR-22, timing, paperwork, and interlock setup.
