🚨 DMV + Criminal Case = Two Battles

A Boulder DUI triggers two different cases:

  1. DMV Express Consent hearing (your license is on the line)
  2. Criminal DUI case (court system)

You only have 7 days to request a DMV hearing if:

  • You took a breath test, or
  • You allegedly refused testing

If a blood test was taken, the DMV sends the notice later.


✅ The DMV Hearing (Updated for 2025)

All DMV Express Consent hearings in Colorado are now via Zoom — statewide.

There are no longer Boulder-specific hearing officers, and hearings are not held in person.

If I represent you, you typically do not need to attend, unless there’s strategic testimony.

How long do I have to save my license?


Seven days from arrest to request a DMV hearing (if breath test or alleged refusal).
Miss that deadline = automatic revocation.


Do I have to go to court in Boulder?


Yes. All Boulder County DUI cases go to Boulder or Longmont courthouse depending on where the arrest occurred.


Can my DUI be reduced or dismissed?


Sometimes — if evidence is weak (stop issues, testing issues, lack of probable cause).
If not, I fight for the best alternative or we take the case to trial.


Will I have to appear for every court date?


Not always. In many misdemeanor DUIs, I can request a waiver of your personal appearance — court dependent.


I live out of state. Can you still represent me?


Yes — you don’t always have to fly back for every setting.
Remote options are available in some cases, but appearance rules are ultimately up to the court and the judge.
