Built on Trust, Focused on Results
Boulder / Boulder County DUI Lawyer
Charged with DUI in Boulder? I personally handle your case — not a case manager.

🚓 Boulder DUI Defense — Focused Representation, Not Case Managers
If you were arrested for DUI or DWAI in Boulder County, you are dealing with one of the most active DUI jurisdictions in Colorado. Boulder’s enforcement is driven by:
- CU Boulder student population + nightlife
- Heavy bar/restaurant concentration on Pearl Street
- Roadside patrols along US-36 / Highway 93 / Canyon Blvd
- Longmont, Louisville, Lafayette, and Erie municipal corridors
I’m Monte Robbins, a Colorado DUI defense attorney with 20+ years focused on DUI and serious traffic cases statewide.
When you hire me:
- You work directly with me, not a call screener or case manager.
- I handle everything start to finish — DMV + criminal case.
- I defend out-of-state clients frequently — minimizing travel when possible.
DUI defense is not a side practice.
It’s what I do.

🚨 DMV + Criminal Case = Two Battles
A Boulder DUI triggers two different cases:
- DMV Express Consent hearing (your license is on the line)
- Criminal DUI case (court system)
You only have 7 days to request a DMV hearing if:
- You took a breath test, or
- You allegedly refused testing
If a blood test was taken, the DMV sends the notice later.
✅ The DMV Hearing (Updated for 2025)
All DMV Express Consent hearings in Colorado are now via Zoom — statewide.
There are no longer Boulder-specific hearing officers, and hearings are not held in person.
If I represent you, you typically do not need to attend, unless there’s strategic testimony.
We challenge:
- The legality of the stop
- Whether probable cause existed
- Whether Express Consent procedures were followed
Out of state? Zoom hearings mean you don’t have to fly back just to fight for your license.
🧠 Why Boulder DUI Defense Is Different
Boulder is not a casual, “just plead out” jurisdiction.
- Prosecutors are experienced.
- Cases move fast.
- BAC science and testing procedures matter.
I identify the pressure points:
- Lack of probable cause
- Bad roadside testing conditions (uneven lighting, gravel shoulder, wind)
- Body-cam inconsistencies
- BAC issues (mouth alcohol, GERD, timing issues, improper 15-minute observation)
You carry no burden of proof.
The state must prove guilt beyond a reasonable doubt.
⚠️ If you have prior DUIs, Colorado treats repeat offenses harshly. Learn more on my [Felony DUI in Colorado] page.
❓ Boulder DUI FAQs
How long do I have to save my license?
Seven days from arrest to request a DMV hearing (if breath test or alleged refusal).
Miss that deadline = automatic revocation.
Do I have to go to court in Boulder?
Yes. All Boulder County DUI cases go to Boulder or Longmont courthouse depending on where the arrest occurred.
Can my DUI be reduced or dismissed?
Sometimes — if evidence is weak (stop issues, testing issues, lack of probable cause).
If not, I fight for the best alternative or we take the case to trial.
Will I have to appear for every court date?
Not always. In many misdemeanor DUIs, I can request a waiver of your personal appearance — court dependent.
I live out of state. Can you still represent me?
Yes — you don’t always have to fly back for every setting.
Remote options are available in some cases, but appearance rules are ultimately up to the court and the judge.
